O que é a convenção do condomínio e qual a diferença para Regulamento Interno

Today we are going to address a subject that is fundamental for good management: What is the condominium convention and what is the difference to Internal Regulation .

Among the various issues that we have already discussed here, on Condominium Management, this is an issue that also needs to be addressed, because although one completes the other there are differences between the condominium status and the Internal Regulation. 

A trustee interested in the welfare, and in the organization of the condominium, must ensure that everyone follows the rules of the condominium .

For a better understanding of this issue, the difference between convention and the regiment, we will begin by addressing what the  condominium convention is and in what situation it applies.

 What is the condominium convention and

The condominium convention is a set of more general, detailed rules about the duties and rights of the condominium.

It involves everything that concerns:

  • Condominium structure – used to inform conventions when performing structural works or even when it comes to contracting services to improve the infrastructure of the condominium.
  • Collection of fines – applies when there is noncompliance with the condominial duty, and is applied by the receiver.
  • Duties of the trustee – its functions and duties are established in the Civil Code and although the condominium has a condominium administrator, the trustee is the principal responsible and who answers in

  • Method of administration – refers to the attributions and services provided, which must be contained in a contract, and which may vary in each case.
  • Types of meetings – are presented in: ordinary (happens annually and contemplates from the accountability until the forecast of budget for the next year) and extraordinary (contemplating diverse subjects and norms of coexistence).
  • Budget and Apportionment – this is the division and application of the budget for the purposes intended as maintenance, payment of bills and expenses of the condominium.
  • Composition of the governing body – determines who will be part of the management of the condominium, usually composed of a receiver, subscriber, caretaker and fiscal adviser (in this case may be 3 tax advisers, as required by the condominium).
  • Description of each building – determines and characterizes the use for residential, commercial or cultural building, for example.

The convention is developed by residents associations and its function is to direct and regulate rights and obligations between condominium owners and condominium owners.

So one can see that the condominium convention dictates what is considered a ‘maximum law’, since the basic parameters are recorded in it.

Diferenças do regulamento interno para a convenção do condomínio

Regulamento Interno podemos dizer que é o detalhe do detalhe, ou seja, serve para especificar o que é permitido e o que é proibido regendo a convivência entre os condôminos.

Tudo o que é comum, para a boa convivência de todos, como:

  • Animais que podem ter no condomínio – aqui podemos determinar por onde eles podem entrar e sair ou locais que são permitidos circular, entre outros detalhes que sejam para determinar a presença dos animais.
  • Uso de piscina, churrasqueira, quadras esportivas – fica determinado, por exemplo, se visitantes podem ter acesso, agendamento de churrasqueira para os moradores, etc.
  • Vaga na garagem – trata-se do direito de cada morador, até mesmo os que não possuem veículos, ter sua vaga na garagem. É fundamental que o respeito ao direito seja mantido.
  • Uso agendado do salão de festas – o condômino deve se responsabilizar pelo local e pelo comportamento de seus convidados, é dever entregar o salão limpo e sem danificar a estrutura ou algum utensílio.
  • Manutenções e obras – são caracterizadas de três maneiras: Necessária (para conservar ou impedir uma deterioração), Útil (para tornar prático ou facilitar o uso) e Voluptuária (para aumentar o uso seja para recreio ou para simples deleite).
  • Uso correto de elevadores- fica determinado quem usará o elevador social e o de serviço, por exemplo. Ou em que ocasião deve se usar o elevador de serviço, em alguns condomínios os banhistas devem usá-lo ao sair da piscina, também deve ser utilizado para entrada e saída de animais de estimação.

Normalmente o Regulamento Interno é aprovado, em assembléia, até seis meses após a ocupação do condomínio

In this case we realize that the rules of conduct of condominium owners when it comes to environments for common use form the Internal Regulation of the condominium.

Sometimes you do not notice the differences, because in some condominiums, the regulation and the convention are part of the same document.

Therefore, the difference between the condominium agreement and the internal regulation is that:

  • The condominium convention determines the care of the institution’s internal and external affairs.
  • The Internal Regulation determines the rules of the condominium, to maintain a good coexistence among all.

But neither the regulation nor the convention can contradict the legislation in force in the country.

It is worth remembering that when living in a condominium, among other things, good living is a daily exercise, the rules of the condominium serve to set limits, therefore, it is important to have good sense when living in society.

A good way to analyze the importance of the rules of the condominium is asking the following question: If every inhabitant resolves to disregard what is condominium convention or in the Internal Regulation , will it give problem? If the answer is yes, it should not be done.
